Terms & Conditions

1. Application

These Terms & Conditions ("T's & C's") apply to any quotation, proposal, purchase order, installation, maintenance, modernisation or repair service provided by IFE Elevators South Africa (Pty) Ltd ("IFE", "we", "us" or "our"), registration number [Company Registration Number], to any customer ("you" or "the Customer") who engages our services, whether initiated via ife-staging.webflow.io or otherwise.

Where a separate signed written agreement exists between IFE and the Customer for a specific project, the terms of that agreement shall prevail over these T's & C's to the extent of any conflict.

2. Quotations and Orders

Quotations issued by IFE are valid for the period stated on the quotation, or if no period is stated, for 30 days from the date of issue. A quotation does not constitute a binding contract until accepted in writing by the Customer and confirmed by IFE.

Prices are subject to change to reflect variations in exchange rates, materials, site conditions, or scope, and any such changes will be communicated to the Customer before proceeding.

3. Site Requirements and Access

The Customer is responsible for ensuring safe and timely access to the installation or service site, and for providing accurate site information (including building specifications and any site hazards) prior to commencement of works. Delays caused by inadequate site access or inaccurate site information may result in adjusted timelines or additional costs.

4. Installation and Delivery

Estimated delivery and installation timelines are provided in good faith but are not guaranteed, as they may be affected by factors including customs clearance, manufacturing lead times, and site readiness. IFE will keep the Customer informed of any material delays.

5. Payment Terms

Unless otherwise agreed in writing, payment terms will be specified in the applicable quotation or agreement. Late payment may result in suspension of works and interest charges as permitted by South African law.

6. Warranties

IFE provides warranties on products and installation works as specified in the applicable quotation, purchase agreement or product documentation. Warranties do not cover damage resulting from misuse, unauthorised modification, lack of routine maintenance, or normal wear and tear.

Nothing in these T's & C's is intended to limit any right or remedy to which the Customer is entitled under the Consumer Protection Act 68 of 2008, where that Act applies to the transaction.

7. Maintenance Services

Where the Customer engages IFE for ongoing maintenance, the scope, frequency and response times for such services will be set out in a separate maintenance agreement. Failure to maintain equipment in accordance with IFE's recommendations, or use of third-party parts or servicing not approved by IFE, may affect warranty cover and equipment safety compliance.

8. Limitation of Liability

To the fullest extent permitted by law, IFE's total liability arising out of or in connection with any order or service shall not exceed the value of the applicable order. IFE shall not be liable for indirect, incidental or consequential losses, including loss of profit or business interruption, except where such liability cannot lawfully be excluded.

9. Compliance

IFE's products and installation services are designed to comply with applicable South African safety standards for lifts, escalators and related equipment. The Customer is responsible for ensuring the building and site otherwise comply with applicable regulations relevant to the Customer's own obligations.

10. Cancellation

Cancellation of a confirmed order by the Customer may be subject to costs already incurred by IFE (including manufacturing, materials and labour already committed), which will be communicated to the Customer at the time of cancellation.

11. Force Majeure

Neither party shall be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, load-shedding, strikes, or governmental action.

12. Governing Law and Jurisdiction

These T's & C's are governed by the laws of the Republic of South Africa, and the parties submit to the exclusive jurisdiction of the South African courts.

13. Changes to These Terms

IFE may update these T's & C's from time to time. The version applicable to a given order or service is the version in effect at the time that order or service is confirmed.
